WHO IS PROTECTED BY THE LAW? 

 

The Whistleblower Act applies to anyone who, regardless of the nature of their work tasks, may have gained information about breaches falling within the scope of the law in a work-related context.

 

It does not apply to completely external parties such as customers or feedback providers. This is because they do not hold a position within the organisation subject to the report that would necessitate special protection against potential retaliation. 

Those entitled to protection include: 

  • Employees and public servants 
  • Self-employed persons 
  • Corporation or foundation board members and managing directors 
  • Voluntary workers and trainees 
  • Former employees and jobseekers

In certain situations, individuals other than the whistleblower themselves may also be protected if they are at risk of retaliation. Such protected individuals may include those assisting the whistleblower in the reporting process and third parties such as colleagues who are connected to the whistleblower and may be subject to retaliation in a work-related context.
